Services
- EQUINOXE will provide caregiving services and/or health care management (“SERVICES”) for the CLIENT, which are consistent with the CLIENT’s needs. Examples of the tasks that Equinoxe staff can perform: help with activities of daily living (such as bathing and showering, dressing, personal hygiene, mobility, laundry, exercises, shopping, medication reminders), accompanying to medical appointments, emotional support, meal preparation, light housekeeping, activities and discussion, cognitive stimulation, monitoring, and other tasks the CLIENT cannot do alone.
Fees and payment
- PURCHASER agrees to a minimum 4-hour shift, billed at an hourly rate based on the type of service. Rates may change over time, and the PURCHASER agrees to pay the current rate when services are provided. Invoices are due upon receipt. Late payments (over 15 days) will incur interest of 2% per month (24% annually).
- If a CLIENT requests that a particular caregiver works more than 40 hours a week, the hourly rate for that caregiver increases to one and a half times the quoted rate for those additional hours. No caregiver may be asked to work more than 60 hours in any seven-day period.
- Statutory holidays are billed at double the regular rate. CLIENTS may cancel services on those days with at least 7 days’ notice. Last-minute requests for evenings, weekends, or holidays will include a premium charge based on the service provided. If no free parking is available near the visit’s location, parking fees will be charged, with prior approval from the CLIENT. If EQUINOXE staff live more than 34 km from the CLIENT, mileage may be charged at $0.72/km, with prior approval from the CLIENT before the visit. Gratuities are not accepted by EQUINOXE staff.
- If the PURCHASER asks EQUINOXE to place orders for the CLIENT, they agree to pay the full cost plus applicable taxes and a 30% administrative fee. Additional administrative tasks outside of the scope of the services will be billed at $100/hour, in 15-minute increments, plus applicable taxes.
- You may not ask EQUINOXE staff for their personal contact details or contact them directly. All communication must go through EQUINOXE’s administrative team. However, you can request that staff call you during service hours to give updates or discuss the care plan.
Schedule changes, cancellation and termination
- Schedule changes must be made with the EQUINOXE office 48 hours in advance (4 hours in case of an emergency). If proper notice is not given, the client may be charged in full for the scheduled service. Between 48 hours and 24 hours, 50% of the entire shift will be charged, less than 24 hours, 100% will be charged.
- During the services and for two years after it ends, the PURCHASER or CLIENT will not hire or solicit EQUINOXE employees. If an EQUINOXE employee is hired privately, a placement fee equal to three months’ salary (based on a 40-hour week) will apply.
- Either party can end the SERVICES with written notice—5 days in advance for services of one month or more, and 48 hours for shorter services—to allow for proper closure. The PURCHASER must pay for all services and expenses up to and including the termination date, even if some third-party invoices are received by EQUINOXE after that date.
- EQUINOXE respects the CLIENT and PURCHASER’S right to privacy and undertakes to protect and guard confidential all information that is given in confidence and all information of a confidential nature. EQUINOXE will not disclose confidential or personal information without prior consent unless the CLIENT’S well-being is in jeopardy, and/or except as mandated by federal or provincial law.
General terms and conditions
- EQUINOXE agrees to provide services with care, professionalism, and in the CLIENT’s best interest. The PURCHASER accepts this and agrees not to hold EQUINOXE responsible for any issues related to the CLIENT’s health or pre-existing conditions.
- The PURCHASER also agrees not to hold EQUINOXE or its team responsible for any issues related to managing the PURCHASER’s finances, as EQUINOXE does not handle financial matters.
- While EQUINOXE strives to refer third party providers of high quality, it cannot and does not assume liability for the actions of third-party resources or service providers.
- These terms and conditions shall be governed by and interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.
- If any provision of these terms and conditions is held to be invalid or unenforceable in whole or in part, such invalidity or unenforceability will attach only to such provision or part thereof, and the remaining part of such provision and all other provisions hereof will continue in full force and effect.
